I don't see why not, it doesn't seem to be a trace or anything. The artist could have used the other art for reference, but I am pretty sure that is fine. So I would say go on ahead.

Those images look completely different, so there's no problem with duplicates. You have to have images that look pretty much identical: Same size (Scale-wise), angle, etc.
